American Dusk: Donald Trump signs executive order shutting down department of education

This article critically analyzes President Donald Trump’s measures aimed at dismantling the U.S. Department of Education and imposing budget cuts on universities, showing how these actions threaten the right to education, fundamental rights, and the health of American democracy. The objective is to demonstrate how such policies undermine institutional structures and democratic values. The methodology is bibliographic with a qualitative approach, drawing on authors like Martha Nussbaum, Steven Levitsky, Daniel Ziblatt, and Gina Pompeu, and uses exploratory and descriptive analysis of ongoing events. The main findings reveal that these measures weaken public education, compromise university autonomy, and reflect an orchestrated erosion of democratic institutions. The study highlights the judiciary’s central role, through the system of checks and balances, in blocking unconstitutional executive orders and exercising necessary judicial activism to uphold the rule of law. The conclusion emphasizes that public institutions and civil society must remain vigilant and mobilized to defend democracy, pluralism, and fundamental rights—especially in the face of the potential risks posed by a third Trump presidential term, which could deepen democratic backsliding.
